Elements of administrative decentralization

Abstract

This research investigates the administrative decentralization system, recognized as one of the most vital modern administrative models designed to distribute administrative functions between the central government and local bodies endowed with legal personality to manage specific institutions. The study conceptualizes administrative decentralization by reviewing its definitions to clarify its legal nature. Furthermore, it examines the core pillars necessary for the system's existence, which affirm the presence of distinct local interests managed by elected local bodies subject to central authority oversight (administrative guardianship). Additionally, the paper addresses the elements of administrative decentralization that secure the administrative and financial independence of local entities. Specifically, this study analyses the stance of Iraqi legislators regarding the decentralization of executive power, highlighting the nature of the relationship between local bodies and central authorities in light of the Iraqi Constitution of 2005 and the Law of Provinces Not Incorporated into a Region No. 21 of 2008. Finally, it outlines the scope of supervision imposed on local entities to ensure their autonomy without compromising the unity of national administration and finance.
